Healthy Discretion in the Judicial System essays
There are many reasons why healthy discretion is such a critical tool in the criminal justice system.Here are some reasons why I believe healthy discretion should be used in every decision made throughout the criminal justice system.
Thefirst reason is for the safety of the public.If not for healthy discretion, the sense of power in the law enforcement field could be taken too far.One example of this is police brutality.If an officer is being attacked, I feel they should have the right to defend themselves, to a point.I also feel there is a line to be crossed, and when this line is crossed, it becomes something more than making a rational decision about how to deal with the situation.The choices an officer makes in these types of situations could result in a variety of different outcomes.If the officer makes a healthy decision on how to deal with the suspect, it could very well result in saving that officer's job; Avoiding prosecution, and other consequences that come with police brutality, as well as adding protection for the suspects themselves.
Another need for discretion is in the courts themselves. Say for instance that a lower class blue-collar worker is convicted of a heinous crime, and the same day an upstanding wealthy individual is convicted of the same crime; It is up to the judge to be professional and use healthy discretion to ensure that both parties receive a sentence that fits the crime they committed, rather than basing his decision on social standing.On the other hand discretion gives the judges the right to choose what evidence is entered into a case in that judges courtroom.In other words if a judge feels that a piece of evidence is prejudicial, he can exclude that piece of evidence to ensure that the accused has as fair a trial as possible.
